In these Terms:
By creating an Account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an Organization, you represent that you have authority to bind that Organization. If you do not agree, do not use the Service.
Scrumpy is a scrum board and sprint planning tool provided by Scrumpy. We may modify, suspend, or discontinue features at any time with reasonable notice. We will not be liable to you or any third party for any such changes.
You are responsible for maintaining the security of your Account and password. You must not share your credentials or allow others to access your Account. You must notify us immediately at support@scrumpy.it if you suspect unauthorized access. We reserve the right to suspend or terminate Accounts that violate these Terms.
Scrumpy offers a free trial period. After the trial, continued access to paid features requires an active Subscription. Subscriptions are billed on a recurring basis.
All payments are processed by Lemon Squeezy, who acts as the Merchant of Record. By purchasing a Subscription you also agree to Lemon Squeezy's terms. Prices are displayed excluding VAT; applicable VAT is added at checkout based on your location.
You may cancel your Subscription at any time via the billing portal. Access continues until the end of the current billing period. We do not offer refunds for partial periods, except where required by applicable law (including the statutory 14-day right of withdrawal for EU consumers, which does not apply once digital service performance has begun with your express consent).
You agree not to use the Service to:
You retain all ownership rights in the Content you create in the Service. By using the Service you grant Scrumpy a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify (only as needed for technical operation), and display your Content for the sole purpose of providing the Service to you and your Organization. We will not access, use, or share your Content for any other purpose. You can export or delete your Content at any time from the Organization settings.
The Service itself — including the Scrumpy name, logo, software, design, source code, documentation, and all related intellectual property — is owned by Scrumpy and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. Nothing in these Terms transfers any intellectual property rights in the Service to you.
You may stop using the Service and delete your Account or Organization at any time. We may suspend or terminate your access if you materially breach these Terms, with reasonable notice where practicable.
After termination, your Content and personal data are permanently deleted within 30 days, except where law requires us to retain specific records longer (for example, billing data for 7 years to meet Dutch tax obligations). Anonymised aggregate statistics may be retained indefinitely. Before deleting, you can export everything from the Organization settings. See our Privacy Policy for details on retention.
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the extent permitted by applicable law. This does not affect mandatory consumer rights you may have under EU or Dutch law.
To the maximum extent permitted by law, Scrumpy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service, including but not limited to loss of data or loss of profits. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law (such as liability for intent, gross negligence, or death and personal injury).
These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands, without prejudice to your rights as a consumer under the law of your country of residence.
We may update these Terms from time to time. If we make material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
